Lasting Power of Attorney

A Lasting Power of Attorney is a legal document which allows a person who is at least 21 years of age (“donor”), to authorize one or more persons whom you trust to be reliable, competent and capable (“donee(s)”) to make healthcare and/or financial decisions on your behalf in the unfortunate event if you should lose your mental capacity.

If you do not appoint a Lasting Power of Attorney and become incapacitated, your spouse or another family member will have to apply to the court to control your assets or access your bank accounts. This is a complicated and expensive process. Accordingly, by having a Lasting Power of Attorney in place, it alleviates the stress and difficulties faced by your loved ones if you should lose mental capacity.

All Lasting Power of Attorney applications have to be witnessed and certified by a practicing lawyer, a registered psychiatrist or medical practitioner accredited by the Public Guardian.
